1. This agreement is in effect for as long as the Renter keeps the account current. This agreement may be terminated by the Renter or The Violin Shoppe.
2. The initial trial period is three months. The up-front cost to rent an instrument is three times the monthly fees plus any security deposits. Within three months, return the instrument in its original condition to receive a seventy-five percent (75%) refund. After three months, all monthly rental fees will be considered rent and no refunds, except deposits, will be given.
3. Except for typical wear-and-tear, instruments must be returned in the condition in which they were taken. The renter is responsible for the safekeeping of the instrument. Refurbishing costs apply for excessive wear.
4. Strings are warranted for ten (10) days. After that, there will be no labor charge to install strings purchased at The Violin Shoppe. Bows are warranted for thirty (30) days against manufacturing or material defects.
5. Instruments remain the property of The Violin Shoppe during the rental period.
6. During the rental period, maintenance of the instrument is INCLUDED at no extra cost. The Violin Shoppe will perform requested maintenance to keep the instrument in a playing condition. The type of maintenance and/or repairs performed is at the discretion of The Violin Shoppe. Excluded are repairs of normal wear-and-tear, repairs to the varnish, damage caused by abuse or by not following the care instructions, repair of a broken cello or neck bridge, and replacement of strings and bow hair after their warranty period expires. Coverage for total loss of the instrument is available through the Optional Replacement Plan offered by The Violin Shoppe or by the renter's own homeowner and/or renter insurance policy. It is agreed that The Violin Shoppe is allowed to work with the Renter's insurance company to recover any money still owed on the instrument.
7. Optional Replacement Plan: With proof that The Violin Shoppe considers satisfactory, instruments stolen or damaged beyond repair will be replaced with an instrument of comparable quality, subject to stock on hand and availability. For instruments stolen by forcible entry, a copy of the police report is required. For damage beyond repair, excluding a broken cello or bass neck, return the damaged instrument along with a written report of the circumstances involved.
8. Instruments are guaranteed against defects in materials or workmanship during the rental period or for the remainder of the usual two year warranty period if the instrument is purchased outright.
9. The renter assumes any liability from the use of the instrument.
10. Seventy-five percent (75%) of the rental payments, not including the Optional Replacement Plan fees, can be applied to the ownership of the instrument by notifying The Violin Shoppe in writing.
11. The Renter agrees to allow The Violin Shoppe to conduct a credit check.
12. Purchased accessories, such as tuners, metronomes, shoulder rests, humidifiers and stands, extra bows, etc., are not part of the rental agreement.
13. If the Renter defaults on payments, the equipment must be returned immediately. Failure to return unpaid equipment may result in criminal prosecution and liability for expenses incurred by The Violin Shoppe in the recovery of the unpaid equipment such as court costs and legal fees.
14. A loaner instrument will be made available for use free of charge when the Renter's equipment is being repaired.
